Can I get compensation if my flight was delayed or cancelled due to strike?
In 2018, the European Court of Justice ruled that flight disruptions caused by strikes among cabin crew or other airline staff qualifies for compensation. With this addition to EU-regulation 261/2004, it is no longer necessarily regarded as extraordinary circumstances if airline employees decide to go on a sudden strike due to unexpected organisational restructurings. This means that the airline is required under EU-law to pay compensation to the passengers whose flights have been cancelled or delayed due to the industrial action.
When am I entitled to compensation?
You are entitled to compensation if your flight was cancelled due to airline strike, and you were not notified of this at least 14 days prior to your scheduled departure. If your flight was cancelled, the airline must offer a rebooking on an alternative flight within reasonable time. If they cannot offer you a replacement flight, you are entitled to a refund of your original tickets, so you can purchase new tickets. If your new tickets are more expensive than your original tickets, the airline must compensate for the price difference. Remember to save all documentation proving that the airline has not offered you a rebooking within reasonable time and save your receipts for your purchase of new tickets.
If your flight cancellation or delay results in additional expenses for acommodation, food, drinks or alternative transportation, the airline is obligated to refund these. Remember to save all your receipts.
In addition to the above, you are entitled to compensation of up to €600 if you arrive more than three hours later than expected at your final destination.
