Air passengers’ right to compensation has been adopted in the EU regulation (EC) 261/2004. The regulation ensures that air passengers have the same rights no matter what airline they are travelling with. Whether you are entitled to compensation also depends on the airline you are travelling with. The rules apply for:

  • Departure from a member state – arrival in a member state: All airlines
  • Departure from a member state – arrival in a non-member state: All airlines
  • Departure from a non-member state – arrival in a member state:  Airlines based in a member state

There might also be applicable air passenger rights in countries that are not covered by the EU regulation. However, these will normally not include a financial compensation.

Delayed flight

As an air passenger you can be entitled to compensation if your flight is sufficiently delayed. The length of the delay depends of how much later than expected you arrive at your final destination. At the same time, the length of the flight also matters. In order to claim compensation, you must be:

  • More than 3 hours delayed on a flight of 0-3500 km or
  • More than 4 hours delayed on a flight that exceeds 3500 km to or from the EU

Whether we can claim compensation for your delayed flight depends on the cause of the delay. The most frequent causes that usually entitle you to compensation are technical problems or illness among the crew.

Cancelled flight

When your flight is cancelled, you may be entitled to a compensation. It will depend on the reason for the cancellation and how soon the airline notifies you about the change. If the airline has announced the cancellation less than 7 days prior to departure, you can apply for compensation if you arrive later than 2 hours after expected. If the airline has announced the cancellation less than 14 days prior to departure, you can apply for compensation if you arrive later than 4 hours after expected.

In case, your flight gets redirected and you arrive within the following timeframes, the airline can reduce your compensation by 50%:

  • Less than 2 hours after expected on a short flight of up to 1,500 km
  • Less than 3 hours after expected on a flight of 1,500 - 3,500 km or within the EU
  • Less than 4 hours after expected on a flight of more than 3,500 km. outside of the EU

In addition to the financial compensation, you may also be entitled to further assistance during the delay. This includes meals and refreshments, two phone calls or e-mails, and accommodation and transport to the hotel if this becomes necessary.

Overbooked flight

Passenger rights also apply if your flight is overbooked and you consequently are denied to board. Your rights may include a refund of the ticket, paid food and drinks while waiting for a new departure, and a financial compensation from the airline of up to 600 euro per passenger.

However, the rights to compensation for a denied boarding do not apply if the rejection is due to:

  • Inadequate identification
  • Inadequate visa or entry permit
  • Late check-in
  • Safety or health issues
  • You in other ways do not comply with the airline’s terms and conditions.

Compensation amounts

The compensation ranges between 250-600 euro per passenger. The amount is determined by the length of your flight and the length of your delay. You may be entitled to:

  • 250 Euro - If you are more than 3 hours delayed on a flight of up to 1.500 km
  • 400 Euro - If you are more than 3 hours delayed on a flight of 1.500-3.500 km or inside EU
  • 600 Euro - if you are more than 4 hours delayed on a flight of 3.500 km travelling to or from the EU.

In some cases, the airline can halve the compensation. This applies, if you have been notified about the delay in good time ahead of departure and the delay doesn’t exceed 4 hours.

Air passengers are also entitled to meals, refreshments and two free phone calls or e-mails after two hours of delay. This applies regardless of the cause of the delay. If your delay drags out, the airline is obliged to offer you a hotel in the waiting time and pay for the transport to and from the airport.

Extraordinary circumstances

Sometimes, the airline will reject your claim for compensation with the reason that the delay was caused by extraordinary circumstances – also known as force majeure.

Extraordinary circumstances are beyond the airline’s control and for this reason, you won’t be entitled to a compensation. Extraordinary circumstances include:

  • bad weather
  • natural disasters
  • strikes in some cases
  • terror threats

Often you may also find that the airline wrongfully rejects your claim for compensation with this reasoning. Therefore, it is important to be aware that when the delay is caused by airplane problems like technical faults, the cargo, or crew, in many cases you will be entitled to a compensation.
